ARTICLE 2 – SUBJECT OF THE AGREEMENT

The subject of this Agreement is to determine the rights and obligations of the parties in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the online booking, sale, and payment of dental care and healthcare services (including examination, treatment, implants, smile design, etc.) ordered electronically by the BUYER through the SELLER’s website (https://luks.clinic).

ARTICLE 3 – SERVICE AND PAYMENT DETAILS

ARTICLE 4 – GENERAL PROVISIONS

  1. The BUYER declares that they have read and understood the preliminary information regarding the basic characteristics, sales price, payment method, and execution of the service on https://luks.clinic and provided necessary confirmation in the electronic environment.

  2. The service covered by this Agreement shall be performed at the SELLER’s clinic address specified above on the appointment date designated by the BUYER.

  3. The SELLER is responsible for providing the contractual service at the scheduled appointment time in compliance with medical and health regulations.

  4. For the performance of the service, it is mandatory that this Agreement is electronically confirmed and the full amount is paid via the SELLER’s secure payment infrastructure (EasyGo).

ARTICLE 5 – RIGHT OF WITHDRAWAL, CANCELLATION AND REFUND POLICY

  1. The BUYER has the right to cancel or reschedule the appointment free of charge by contacting the SELLER at least 24 hours prior to the scheduled appointment time.

  2. For cancellations made less than 24 hours before the appointment, or if the BUYER fails to attend without a valid excuse, a reasonable administrative fee may be deducted, or a refund may not be issued due to physician and clinic schedule allocation.

  3. Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for custom-made medical/dental prosthetics or health and hygiene-sensitive services that have been initiated or prepared specifically for the patient.

  4. Upon approval of a refund, the paid amount will be returned to the BUYER’s payment card via the EasyGo infrastructure within 7 to 14 business days.

ARTICLE 6 – JURISDICTION AND AUTHORIZED COURTS

In the settlement of any disputes arising from this Agreement, Consumer Arbitration Committees up to the monetary limits announced by the Ministry of Commerce, as well as the Consumer Courts and Execution Offices of Istanbul (Esenyurt), shall have jurisdiction.
